1. Agreement and supplier information
These Terms of Service (“Terms”) apply to use of Water Cleanic’s customer-facing websites and services requested through them. “Water Cleanic”, “we”, “us” and “our” refer to Water Cleanic (Pty) Ltd.
Customer contact: hello@watercleanic.com · +27 81 382 7969 · Gauteng, South Africa.
Company disclosure: WATER CLEANIC (PTY) LTD
Registration number: 2024/219014/07
Registered office: 833 Joan End, Erand Gardens, Midrand, Gauteng, 1685
By submitting a service request, accepting a quotation, making payment, or otherwise entering into a service transaction with Water Cleanic, you agree to the applicable Terms, quotation and scope of work, subject always to rights that cannot lawfully be excluded under South African law.
2. Our services
Water Cleanic provides water-related services that may include site assessments, water sampling coordination, laboratory testing arrangements, interpretation of water-quality results, technical recommendations, treatment-system quotations, supply, installation, commissioning, maintenance and related support. The exact service supplied is the service described in the applicable quotation or written scope.
Information on the website is general information and does not by itself constitute a site-specific technical recommendation, guarantee of water quality, or final treatment design.
3. Assessments and water testing
An assessment is intended to gather information needed to understand a site, water source, intended use and treatment requirements. Assessment packages may differ in scope. The package description and quotation applicable at the time of purchase determine what is included.
Water characteristics can change over time and can vary between sampling points. Test results relate to the sample and conditions represented at the relevant time. A result should therefore be interpreted in its proper context rather than treated as a permanent guarantee of a water source.
4. Quotations and acceptance
A quotation is valid for the period stated on it. Prices, inclusions, exclusions, taxes, delivery, installation and other charges are governed by the quotation. A quotation is not accepted merely because it has been viewed; acceptance occurs through the acceptance method specified by Water Cleanic or otherwise agreed in writing.
Treatment quotations prepared after testing may differ from initial estimates because the final recommendation depends on site information, laboratory findings, capacity requirements and other technical factors.
5. Payments
Payment must be made using a payment method made available or approved by Water Cleanic. Where electronic funds transfer is used, customers must use the reference requested by Water Cleanic. Uploading or sending proof of payment does not by itself establish that funds have cleared. Water Cleanic may verify receipt of funds before confirming payment or commencing the next paid stage.
Never send card PINs, online-banking passwords or other banking credentials to Water Cleanic.
6. Site visits and access
The customer must provide reasonable and safe access to the site, water source, sampling points and relevant equipment at the agreed time. The customer should disclose known site hazards, access restrictions and relevant technical information before the visit. Water Cleanic may postpone or stop work where conditions are unsafe or prevent the agreed work from being performed reasonably.
Appointment times and arrival windows are estimates unless expressly agreed otherwise. We will communicate material scheduling changes where reasonably practicable.
7. Samples and third-party laboratories
Where laboratory testing is included or arranged, samples may be analysed by an independent laboratory or other competent service provider. Laboratory turnaround times can be affected by the selected analysis, sample condition, laboratory capacity and other factors outside Water Cleanic’s direct control.
Water Cleanic may interpret laboratory results for the purpose of developing a practical water-treatment recommendation, but does not alter or manufacture the underlying laboratory result.
8. Treatment recommendations and performance
Treatment recommendations are based on the information reasonably available to Water Cleanic, which may include the sample results, site assessment, water demand, source conditions and intended use. Customers should inform us if the source, demand, intended use or other material site conditions change.
Any specific performance commitment, warranty, maintenance requirement or treated-water target is governed by the written quotation, specification or service agreement. Nothing in these Terms excludes a consumer right or remedy that may not lawfully be excluded.
9. Customer responsibilities
Customers must provide information that is accurate to the best of their knowledge, identify the intended use of the water, provide reasonable site access, follow applicable operating and maintenance instructions, and promptly notify Water Cleanic of material changes that could affect the service or treatment system.
A customer must not misuse the website, interfere with its security, submit unlawful or malicious content, impersonate another person, or attempt unauthorised access to Water Cleanic systems.
10. Changes, cancellations and refunds
Cancellation, rescheduling and refund rights depend on the service, the stage of work, costs already reasonably incurred, the applicable quotation and mandatory consumer rights. Where a specific quotation contains a cancellation or refund provision, that provision should be read with these Terms and applicable law.
Water Cleanic will not use these Terms to remove rights that a consumer is entitled to under applicable South African consumer law. Customers should contact us promptly if they need to change or cancel a booked service so that we can explain the options applicable to that transaction.
11. Website availability and third-party services
We aim to keep our websites available and accurate, but online services may occasionally be unavailable for maintenance, hosting, network or security reasons. We may update website content, forms and functionality as our services evolve.
Links or integrations involving third-party services do not mean that Water Cleanic controls those third parties. Their own terms and privacy practices may apply.
12. Intellectual property
The Water Cleanic name, branding, website design, original text, graphics, documents, technical materials and other original content are owned by or licensed to Water Cleanic unless stated otherwise. Customers may use documents supplied to them for the purposes for which they were provided, but may not commercially reproduce or misrepresent Water Cleanic materials without permission.
13. Responsibility and limitation of liability
Water Cleanic will perform its services with the standard required by applicable law and any specific written agreement. To the fullest extent permitted by law, Water Cleanic is not responsible for loss caused by inaccurate or incomplete information supplied by the customer, undisclosed site conditions, changes in the water source after sampling, misuse or unauthorised alteration of equipment, failure to follow maintenance requirements, or events outside Water Cleanic’s reasonable control.
Any limitation or exclusion in these Terms applies only to the extent permitted by law. Nothing in these Terms is intended to exclude liability, warranties, remedies or consumer protections that South African law does not permit a supplier to exclude.
14. Electronic communications
Customers may receive operational communications by email, telephone or WhatsApp, including enquiry confirmations, quotations, payment updates, scheduling information, site-visit confirmations, laboratory/project milestones and treatment-quotation updates. Customers are responsible for providing usable contact details and notifying us if they change.
15. Privacy
Personal information is processed as described in our Privacy Policy. By providing information to request a service, you acknowledge that Water Cleanic must process information reasonably necessary to respond to and administer that request.
16. Governing law, changes and severability
These Terms are governed by the laws of the Republic of South Africa. We may update them from time to time. The current version and effective date will be displayed on the website. If any provision is held invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
Nothing in these Terms prevents a customer from using a complaint or dispute-resolution process available under applicable law.
